Medical Tourism Disclaimer

Important notice. This Medical Tourism Disclaimer governs the use of medical tourism services facilitated by Tudeyo LLC. It supplements the TUDEYO Terms & Conditions and Privacy Policy. By accessing or booking medical tourism services through the Platform, you acknowledge and agree to the terms below.

This Medical Tourism Disclaimer (“Disclaimer”) governs the use of medical tourism services facilitated by Tudeyo LLC (“Tudeyo,” “we,” “us,” or “our”), a limited liability company registered under the laws of the Commonwealth of Massachusetts, United States, through its platform, including its website (www.tudeyo.com), mobile applications, and services provided by local coordinators (collectively, the “Platform”). By accessing or booking medical tourism services through the Platform, you (“User,” “you,” or “your”) acknowledge and agree to the terms of this Disclaimer. Tudeyo acts solely as an intermediary connecting Users with third-party medical service providers and does not provide medical advice, treatment, or services. This Disclaimer supplements the Tudeyo Terms and Conditions and Privacy Policy, which also apply to your use of the Platform.

Article 1: Role of Tudeyo

1.1 Intermediary Status

Tudeyo operates exclusively as a destination marketing company, facilitating connections between Users and independent third-party medical service providers, including but not limited to hospitals, clinics, and licensed healthcare professionals (collectively, “Medical Providers”) in regions such as Turkey, Colombia, the United Arab Emirates (Dubai), and other operating jurisdictions. Tudeyo does not own, operate, or control any Medical Providers or their facilities, nor does it employ or directly supervise their personnel.

1.2 No Medical Services

Tudeyo does not provide medical advice, diagnosis, treatment, or healthcare services. All medical procedures, consultations, or treatments booked through the Platform are performed at the sole discretion and responsibility of the Medical Providers. Users acknowledge that Tudeyo’s role is limited to arranging introductions and facilitating bookings.

Article 2: User Responsibilities

2.1 Due Diligence

Users are solely responsible for researching and verifying the legitimacy, licensing, accreditation, and reputation of Medical Providers prior to booking services. Tudeyo encourages Users to consult with qualified medical professionals and review provider credentials, certifications, and reviews before proceeding with any medical procedure.

2.2 Informed Consent

Prior to receiving medical services, Users must sign a consent form provided by the Medical Provider, acknowledging the risks, benefits, and potential outcomes of the procedure. Tudeyo is not a party to such consent agreements, and Users assume full responsibility for their decisions to proceed with medical services.

2.3 Travel and Health Insurance

Users are strongly advised to obtain comprehensive travel and health insurance that covers medical tourism, including potential complications, cancellations, or repatriation. Tudeyo shall not be responsible for any costs or losses arising from the absence of adequate insurance coverage.

Article 3: Limitation of Liability

3.1 No Liability for Medical Outcomes

Tudeyo shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from medical services, including but not limited to:

  • Medical complications or adverse outcomes;
  • Misdiagnosis, negligence, or malpractice by Medical Providers;
  • Failure to achieve desired medical results;
  • Financial losses related to medical procedures or associated travel; or
  • Personal injury, disability, or death resulting from medical services.

All risks and liabilities associated with medical services rest solely with the User and the Medical Provider.

3.2 No Guarantee of Service Quality

Tudeyo does not guarantee the quality, safety, or efficacy of medical services provided by third-party Medical Providers. Users acknowledge that any disputes, claims, or grievances regarding medical services must be addressed directly with the Medical Provider.

3.3 Force Majeure

Tudeyo shall not be liable for any delays, cancellations, or failures in service delivery due to events beyond its reasonable control, including but not limited to natural disasters, political instability, or governmental restrictions affecting medical facilities or travel.

Article 4: Booking and Payment Terms

4.1 Medical Service Bookings

All bookings for medical services are subject to availability and confirmation by the Medical Provider. Tudeyo facilitates communication and coordination but does not control the scheduling or delivery of medical services.

4.2 Payments and Deposits

Payments for medical services are processed through secure third-party payment gateways (e.g., Stripe, PayPal, or region-specific processors). Deposits for medical bookings are generally non-refundable unless canceled at least fourteen (14) days prior to the scheduled procedure, subject to the Medical Provider’s cancellation policy and applicable local laws (e.g., consumer protection regulations in Turkey or Colombia).

4.3 Service Fees

Prices for medical services may include Tudeyo’s service fees or commissions payable to coordinators or Medical Providers. Such fees do not affect the User’s cost and are disclosed in accordance with international marketing standards.

Article 5: Compliance with Laws

5.1 Local and International Regulations

Tudeyo facilitates medical tourism services in compliance with applicable laws in its operating regions, including but not limited to Uganda, United Arab Emirates (Dubai), Rwanda, Tanzania, Kenya, Dominican Republic, Colombia, Turkey, Botswana, South Africa, and Namibia. Users and Medical Providers are responsible for ensuring compliance with local healthcare, licensing, and consumer protection laws.

5.2 Data Protection

Personal information, including health-related data, collected for medical tourism bookings is processed in accordance with Tudeyo’s Privacy Policy and applicable data protection laws, such as the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), and Protection of Personal Information Act (POPIA). Users consent to the sharing of necessary personal and health information with Medical Providers solely for the purpose of facilitating bookings.

Article 6: Dispute Resolution

6.1 Disputes with Medical Providers

Any disputes, claims, or liabilities arising from medical services, including but not limited to treatment outcomes, complications, or financial disagreements, are solely between the User and the Medical Provider. Tudeyo shall not be a party to such disputes and bears no responsibility for their resolution.

6.2 Governing Law

This Disclaimer is governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law principles. Any disputes involving Tudeyo shall be resolved through binding arbitration in Boston, Massachusetts, under the rules of the American Arbitration Association, with each party bearing its own costs unless otherwise determined by the arbitrator.

Article 7: Amendments

7.1 Right to Update

Tudeyo reserves the right to amend this Disclaimer at any time, with or without prior notice. Amendments will be effective upon posting to the Tudeyo website or notification to Users.

7.2 Continued Use

Continued use of the Platform or booking of medical services following amendments constitutes acceptance of the revised Disclaimer.

All medical services are provided by independent Medical Providers at their own discretion and responsibility.
